Heard learned counsel for the applicants and learned A.G.A. for the State.

It is submitted by learned counsel for applicants that applicant no.6 is married with the son of opposite party no.2 and there was some matrimonial dispute between them. Several cases are pending between the parties. It is submitted by learned counsel for the applicants that the impugned complaint has been lodged by the opposite party No. 2 / complainant making false and baseless allegations. Learned counsel has referred statement of complainant, recorded under Section 200 Cr.P.C., and statements of witnesses, recorded under Section 202 Cr.P.C., and submitted that no prima-facie case is made out against the applicants. The complainant has not sustained any injury. Referring to facts of the matter, it was submitted that no prima-facie case is made out against the applicants and that the impugned proceedings are malicious and thus, liable to be quashed.

Matter requires consideration.

Issue notice to opposite party no.2 returnable at an early date.

Opposite party no.2 may file counter affidavit within four weeks.

List this case on 15.09.2025.

Till the next date of listing, no coercive action shall be taken against the applicants in Complaint Case No. 12422 of 2023, under Section - 323 I.P.C., Police Station - Kotwali Nagar, District - Bulandshahr, pending in the court of Additional Civil Judge (J.D.) / Judicial Magistrate, Court No.6, Bulandshahr.
