Sri Dinesh Kumar Gupta, Advocate holding brief of Sri Raghawendra Singh, learned counsel for the applicant and Sri B.N. Upadhyay, learned A.G.A. for the State are present.
The present application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to issue a direction to the Chief Judicial Magistrate, Ballia to decide the Case No. 1231 of 2021, (Ramchandra Vs. Shivshankar and others) arising out of Case Crime No. 25 of 2019, under Sections 419, 420, 467, 468, 471 of I.P.C., Police Station- Kotwali, District- Ballia, within stipulated period.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
