Heard Sri Sumit Pandey, learned counsel for the applicants and Sri Vinay Kumar Singh, learned AGA for the State.

The instant application under Section 482 Cr.P.C. has been filed by the applicant seeking quashing of the summoning order dated 20.08.2024, passed by the Judicial Magistrate, Court No.01, Aligarh, in Criminal Complaint Case No.1718 of 2023(Smt. Shristhi Varma Vs. Anil Varma and Another), under sections 323, 324, 417, 403, 451, 504, 506, IPC, Police Station Quarsi, District Aligarh, pending before the Court of learned Judicial Magistrate, Court No.1, Aligarh.

Learned counsel for the applicants submits that the opposite party no.2 is the wife of the applicant no.1 herein, due to the matrimonial dispute between the parties the instant complaint case was filed by the opposite party no.2. However, there is some settlement between the parties and the opposite party no.2 is residing with the applicant no.1. However, no final settlement has yet been arrived at between the parties.

In view thereof, learned counsel for the applicant submits that if the matter is referred to the mediation centre of this Court, there is a possibility of settled of all their dispute and differences amicably and the entire proceedings can be quashed on the basis of the said settlement.

Accordingly, the matter is referred to Mediation & Conciliation Centre, High Court for settlement of dispute amicably.

The applicant is directed to deposit a sum of Rs.55,000/- by way of demand draft / pay order in the name of Registrar General A/c, Allahabad High Court Mediation & Conciliation Centre within a period of two weeks from today. After deposit of the aforesaid amount, the Mediation Centre shall send a notice to the opposite party no.2 to appear before the Mediation and Conciliation Centre of this Court on 29.08.2025. Out of aforesaid amount, a sum of Rs.20,000/- shall be payable to the opposite party no.2 on her first appearance; Rs.15,000/- on her second appearance and Rs.15,000/- on her third appearance or final settlement, whichever is

earlier before the Mediation and Conciliation Centre. The balance amount of Rs.5,000/- shall be retained by the Mediation Centre towards cost of Mediation. The Mediation Centre shall submit its report in the matter within three months.

List this case on 12.11.2025 in the daily cause list before the appropriate Bench.

In view of the fact as noted above and that the matter has been referred for mediation at the Mediation and Conciliation Centre, High Court, Allahabad, as an interim measure it is provided that no coercive action shall be taken against applicants till the next date of listing, from the date of deposit of amount as directed herein above.

However, it is provided that if the amount, as directed above, is not deposited by the applicants within the aforesaid period, the protection granted to the applicant shall automatically stand vacated and the instant application under Section 482 Cr.P.C. shall stand dismissed, without any further reference to the Court.
