Heard learned counsel for the petitioner and learned AGA for the State.

Learned counsel for the petitioner submits that the petitioner is the wife of opposite party no. 2. Earlier, she filed an application under Section 125 Cr.P.C. seeking maintenance from opposite party no. 2, a complaint case against him regarding a demand for dowry, and a complaint under Section 12 of the DV Act. After filing these three cases, as a counter blast, frivolously the impugned complaint has been lodged. It is also submitted that while passing the summoning order, the inquiry mandated under Section 202(2) Cr.P.C. has been done.

It has been further submitted that the impugned proceedings is nothing but an abuse of process of law as it has been lodged as a counter blast to exert pressure upon the petitioner.

The matter, prima facie, requires consideration.

Issue notice to respondent no. 2.

List on 18.04.2025.

¶10

Till further orders of the Court, the impugned summoning order dated 08.10.2024 passed in complaint case No. 246/2024 "Devesh Kumar @ Prince Vishwakarma Vs. Anshika Vishwakarma", P.S. Kotwali Nagar, District Balrampur shall remain stayed.
