Sri Anup B. Shukla, learned counsel for the applicant has submitted that though present application has preferred for quashing the entire proceeding of the Complaint Case No. 375 of 2023, (Sri Krishna Enterprises Vs. Akshar Associate) under section 138 N.I. Act, police station Kotwali Hathras, District Hathras, pending in the court of Learned Additional Civil Judge (S.D.) Court No.1, Hathras and set-aside the impugned summoning order dated 07.08.2023 as well as N.B.W./Section 82 Cr.P.C dated 23.10.2024 & 20.11.2024 passed by the learned Additional Civil Judge (S.D.) Court No.1, Hathras, he confines his relief for compounding under Section 147 of the N.I. Act in view of the judgement in Damodar S Prabhu Vs Sayed Babalal reported in AIR 2010 SC 1907 .

Learned A.G.A. has no objection to the same.

Considering the submissions raised at the Bar, the application stands disposed of granting liberty to the applicant to prefer appropriate proceeding for compounding under Section 147 of N.I. Act and in case such proceeding is preferred before the court concerned, then this Court has no reason to disbelieve that the same shall be decided with most expedition strictly in terms of the judgment passed in Damodar S Prabhu (supra) .
