The applicant by means of the present application under Section 482 Cr.P.C. has assailed the order dated 10.08.2016 passed by the Additional District Judge, Court No.6, Raebareilly in Revision No.34 of 2016 and also prayed for quashing of Complaint Case No.10 of 2015 as well as summoning order dated 23.01.2016 passed by the Additional Chief Judicial Magistrate, Court No.13, Raebareilly.

The facts, in brief, are that earlier the opposite party no.2 filed F.I.R. against the applicant and three other persons namely Mohd. Jamshed Khan, Ashik Ali and Mahesh Prasad Srivastava under Sections 420, 467, 468, 471 I.P.C. on 05.04.2012 alleging therein that House No.665 and 665/1 Ward No.31, Kucha Bheetar Kaharo Ka Adda, P.S. Kotwalli Nagar District Raebareilly was owned by one Ishmile Khan, father of respondent no.2. After the death of Ishmile Khan, Smt. Hidayatun Nisha W/o Mohd. Jamshed Khan, the elder son of Ishmile Khan, got a Will dated 13.10.1988 executed in her favour by committing fraud and thereafter, she instituted

Original Suit No.247 of 2010 seeking decree of declaration in respect to the aforesaid house.

It is alleged that due to the aforesaid fact, opposite party no.2 and other brothers and sisters lost their share in the house. It is alleged that the aforesaid Will is forged and fabricated document and was got prepared with the help of Notrary Mahesh Prasad Srivastava. The police conducted investigation and after investigation, filed a charge sheet against the applicant and Mohd. Jamshed Khan, under Sections 504 and 506 I.P.C.

It appears that thereafter, the opposite party no.2 filed a complaint for registering a case against the applicant under Sections 419, 420, 467, 468, 471 and 120-B of I.P.C. on 07.01.2015 alleging that the House No.665 and 665/1, the old number of which was 34 and 34/1 and subsequently, the number was changed to 559 and 559/1, was owned by his father. The further allegation is that the wife of his elder brother Smt. Hidayatun Nisha (wife of Mohd. Jamshed Khan) got a Will deed executed on 13.10.1988 by playing fraud. It is further alleged that in the said Will, one Ashiq put his thumb impression as witness. It is further alleged that Ashiq, who was alleged to be attesting witness of the Will, died and taking advantage of death of Ashiq, the applicant by playing fraud got the thumb impression of some other person presenting him imposter of Ashiq on the Will.

It is further alleged that the applicant by playing fraud instituted Original Suit No.247 of 2010 for seeking decree of declaration. The aforesaid Suit was got decreed on the basis of compromise.

After filing of complaint, the statement of opposite party no.2 was recorded in which the applicant stated that in the house, the applicant has 1/3 share. She has further stated that her father did

not sign the Will. It is also come on record that the opposite party no.2 has sold 1/3 share of his house in favour of one Nahir Begam.

The trial Court on the basis of evidence and material on record, on perusal of complaint and statement recorded under Section 200 Cr.P.C. concluded that the offence under Section 467 I.P.C. has been made out, and accordingly, the trial Court issues summons to the applicant.

The applicant, thereafter, preferred a Revision before the Court of Additional Sessions Judge, Court No.6, Raebareilly bearing Criminal Revision No.34 of 2016 against the summoning order which was also dismissed by the Revisional Court vide order dated 10.08.2016.

Challenging the aforesaid order, learned counsel for the applicant has contended that the trial Court as well as Revisional Court has committed manifest error of law in concluding that the offence under Section 467 of IPC is made out against the applicant. It is contended that the dispute is purely of civil nature and to pressurize the applicant, the complaint has been filed by the opposite party no.2. It is submitted that the malicious intention on the part of the applicant against opposite party no.2 is apparent from the record inasmuch as the opposite party no.2 had earlier filed an F.I.R. on 05.04.2012 making the same allegation in which the charge sheet had been filed under Sections 504 and 506 I.P.C. and when having been failed in his attempt to get the applicant arrested and to harass, now fresh complaint after three years from the date of filing of earlier complaint has been filed which is nothing but an abuse of process of law. Accordingly, it is submitted that it is a case of quashing of proceedings by this Court in exercise of power under Section 482 Cr.P.C.

Per contra, learned A.G.A. would contend that it is manifest from the record that the allegations made in the F.I.R. are serious in nature inasmuch as in order to usurp the share of opposite party no.2, the applicant got a Will deed executed which is forged and fabricated. Accordingly, it is submitted that the trial Court as well as Revisional Court has not committed any error in concluding that a case under Section 467 of I.P.C. is made out against the applicant.

Be that as it may, the opposite party no.2 had earlier filed an F.I.R. under Sections 420, 467, 468, 471 I.P.C. in which after investigation, the police has filed charge sheet under Sections 504 and 506 I.P.C. on 18.06.2013. Thereafter, on the same allegation, the opposite party no.2 has filed a complaint in the year 2015 i.e. about three years from the date of filing of F.I.R. For the convenience, the contents of the F.I.R. and complaint case are reproduced herein below:-

पयाथर्थी / अयभयहोगश्री यनम्न यनवरेदन करतया हहै :-

धयारया 01- यह यक अयभयहोगश्री करे यपतया महो० इस्मयाईल खयासं कया बनवयायया हहआ पहैतमृक मकयान महोहलया कयचया भश्रीतर कहयारहो कया अडया रयायबररेलश्री मम सस्थत हहै जजिसकया पमुरयानया नसंबर 34 व 34/1 वयाडर नसं० -4 नगर पयाजलकया करे अयभलरेखन मम वरर 1999 तक दजिर चलया आ रहया थया उक्त मकयान मम अयभयहोगश्री कया 1/3 भयाग हहै।

धयारया 02- यह यक अयभयहोगश्री करे यपतया ककी ममृत्यमु यदनयासंक 12-01-1983 कहो हहो गयश्री हहै। यपतया ककी ममृत्यमु करे बयाद उक्त मकयान ससं० 34 व 34/1 कहो बरेईमयानश्री सरे हडपनरे ककी यनयत सरे अयभयहोगश्री करे सगरे बडरे भयाई ककी औरत यहदयायतमुयन्निशयासं पत्नश्री जिमशरेद खयासं यन० महोहलया कयचया भश्रीतर , थयानया कहोतवयालश्री , रयायबररेलश्री नरे अपनरे पयत जिमशरेद खयासं सरे अन्य सहयहोयगयन ककी मदद सरे एक फजिर्थी अपसंजिश्रीकमृत वसश्रीयत यद० 13-10-1988 तहैययार ककी उक्त वसश्रीयत पर अयभयहोगश्री करे यपतया करे हस्तयाकर नहहीं हहै और वसश्रीयत करे गवयाह आयशक करे असंगयठरे करे

यनशयान भश्री नहहीं हहै क्यनयक आयशक अलश्री ककी ममृत्यमु हहो चमुककी हहै , इसश्री कयारण सरे यहदयायतमुयन्निशयासं नरे यकसश्री अन्य व्ययक्त कया असंगयठया लगयाकर आयशक अलश्री कया नयाम जलख यदयया।

धयारया 03- यह यक उक्त वसश्रीयत ककी तहरश् र ी मम यहदयायतमुयन्निशया अयभयहोगश्री ककी पत्नश्री बन गई हहै जिबयक यहदयायतमुयन्निशया अयभयहोगश्री करे भयाई जिमशरेद खयासं ककी पत्नश्री हहै उक्त वसश्रीयतनयामम मम जजिस भवन ससं० 665 व 665/1 कया उलरेख यकयया गयया हहै , वह मकयान नसं० 34 व 34/1 कया नयया नसंबर हहै उक्त दहोनन मकयानन कया वरर 1999 तक नसंबर 34 व 34/1 चलया आ रहया थया।

धयारया 04- यह यक यदनयासंक 01-04-1999 सरे 31-3-2008 तक दहोनन मकयानन कया नसंबर 559 व 559/1 वयाडर नसं० 25 रहया हहै तथया 01-04-2008 सरे वतरमयान समय तक नसंबर 665 व 665/1 हहै और वसश्रीयत यनष्पयादन यदनयासंक 13-10-1988 कहो यदखया यदयया गयया हहै इससरे स्पष्ट जियायहर हहै यक वसश्रीयत कयररचनया करकरे अयभयहोगश्री ककी ससंपजत्ति हडपनरे करे उदरेश्य सरे फजिर्थी बनयायश्री गयश्री हहै।

धयारया 05- यह यक यहदयायतमुयन्निशया नरे उक्त फजिर्थी वसश्रीयत करे आधयार पर एक घहोरणयात्मक वयाद , वयाद ससं० 2437/010 दयायर करकरे दमुरयभ ससंजध करे आधयार पर यडककी भश्री पयाप्त कर जलयया हहै। अयभयहोगश्री नरे जियानकयारश्री हहोनरे पर यडककी यनरस्त करवयानरे ककी कयायरवयाहश्री भश्री कर रखश्री हहै। अयभयहोगश्री नरे अपनरे यहस्सरे करे मकयान कहो नयायहद बरेगम पत्नश्री वयाजसफ खयासं यनवयासश्री कयचया भश्रीतर जजिलया रयायबररेलश्री करे हयाथ यदनयासंक 01-10-011 कहो बमच यदयया हहै तथया यपतया इस्मयाईल खयासं करे मयल दस्तखत अपनरे भयाई महो० हयाजसम खयासं सरे आपसश्री बसंरवयारया जियायदयाद करे मयल कयागजियातन मम मरौजियद हहै।

धयारया 06- यह यक अयभयहोगश्री नरे घरनया यक सयचनया थयानया कहोतवयालश्री पमुजलस कहो भश्री दश्री लरेयकन कहोई कयायरवयाहश्री नहहीं हहई। तब अयभयहोगश्री नरे पमुजलस अधश्रीकक महहोदय , रयायबररेलश्री कहो जिररयरे रजजिस्रटश्री यदनयासंक 02-01-015 कहो सयचनया दश्री लरेयकन आजि तक कहोई कयायरवयाहश्री नहश्री हहई तब न्ययाय पयानरे हरेतमु अयभयहोग - पत्र पस्तमुत कर रहया हहै।

अततः शश्रीमयानन् जिश्री सरे पयाथरनया हहै यक न्ययाययहत मम पररवयाद

The record further reveals that applicant has instituted Original Suit No.247 of 2010 which was decreed on the basis of compromise on 30.09.2011 in which the opposite party no.2 has

filed an application under Order 9 Rule 13 of C.P.C. When the applicant has already filed an F.I.R. on 05.04.2012 on the same allegation on which the complaint has been filed after three years, this Court is of the opinion that it is evident from the record that the intention of opposite party no.2 is only to harass the applicant. There is nothing on record to indicate that the opposite party no.2 has assailed the Will dated 13.10.1988 in any Court of law seeking decree of declaration that the Will is null and void.

The dispute is essentially a civil dispute and it has been given colour of criminal dispute. Therefore, this Court is of the view that since the criminal prosecution has already been launched against the applicant by opposite party no.2 by filing F.I.R. on 05.04.2012 in which charge sheet has been filed, therefore, the present complaint on the same allegation is nothing but an abuse of process of law.

Thus, for the reasons given above, the order dated 10.08.2016 passed by the Additional District Judge, Court No.6, Raebareilly in Revision No.34 of 2016 and the entire proceedings of Complaint Case No.10 of 2015, under Section 467 of I.P.C., Police Station Kotwali, District Raebareilly pending in the Court of Additional Chief Judicial Magistrate, Court No.13, Raebareilly, are hereby quashed.

The application under Section 482 Cr.P.C. is allowed .
