Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 482 Cr.P.C. the applicant has sought for a suitable direction to the Additional Principal Judge, Family Court No. 4, Kanpur Nagar to expedite the proceedings of case no. 2090 of 2022, under Section 125 Cr.P.C., P.S. Gujaini, District Kanpur Nagar and to decide the same within time stipulated by this Court, which is pending before the aforesaid court.

It was submitted by learned counsel for the applicant that the applicant has filed the aforesaid case under Section 125 Cr.P.C. in the year 2022. Earlier the opposite party No. 2 has moved a transfer application before this court, wherein matter was referred for mediation subject to condition that he shall deposit an amount of Rs. 30,000/- before the mediation center. The opposite party No. 2 did not deposit the said amount and thus, the interim order passed in the transfer application has been vacated. It is further submitted that the applicant is facing financial hardship and thus, a direction may be made to the concerned Family court to decide the aforesaid case within specific time frame.

In view of aforesaid, the Family court concerned is directed to expedite the proceedings of the aforesaid case and to decide the same as early as possible, preferably within a period of nine months from the date of production of copy of this order before the court concerned, provided there is no legal impediment.

The application under Section 482 Cr.P.C. is disposed of accordingly.
