Heard learned counsel for the applicants, Ms. Jyoti Yadav, learned counsel for the opposite party No. 2, learned A.G.A. for the State and perused the record.

The present 482 Cr.P.C. application has been filed to quash the entire proceeding of Case Crime no. 691 of 2019(State Vs. Awdhesh Yadav and others) under Sections 498A, 323, 504, 506 IPC and Section 3 and 4 of D.P. Act, 1961, Police Station- Para, District Lucknow along with chargesheet No. 01 dated 25.01.2020 and cognizance/summoning order dated 25.11.2020 passed by the court of learned A.C.J.M.(Fifth), Lucknow on the basis of compromise deed dated 06.11.2025.

Learned counsel for the applicants submits that now parties have entered into compromise, therefore, this Court may please to quash the proceeding for which learned A.G.A. has no objection.

Whether the parties have, in fact, compromised the matter or not, can best be ascertained by the Trial Court as such, compromise has to be duly verified in presence of the parties concerned before the Trial Court.

Accordingly, this application is disposed of with a direction to The Court concerned that if any such compromise is filed before it within two weeks, it shall issue notices to all the signatories to the compromise requiring their personal presence and, thereafter, proceed to verify the compromise within two weeks. If the aforesaid compromise is verified, a report to that effect shall be prepared by the Trial Court and the compromise will be made part of the record.

The Trial Court in that scenario will allow the parties to obtain certified copy of the report as well as compromise and it will be open to the applicants to approach this Court again for quashing of the proceedings.

For a period of one month, the proceedings of Case Crime no. 691 of 2019 under Sections 498A, 323, 504, 506 IPC and Section 3 and 4 of D.P. Act, 1961, Police Station- Para, District Lucknow , shall remain stayed.

Office is directed to return the original compromise deed to the learned counsel for the applicants, if any, after taking the photocopy of the same.
