प्राथीर् के िवद्वान अिधवक्ता श्री अनुराग िसह राठौर तथा िवद्वान अपर शासकीय अिधवक्ता श्री अभय कुमार िसह को सुना तथा पत्रावली का अवलोकन िकया।

धारा 438 दं०प्र०सं० द्वारा प्रस्तुत प्राथर्ना-पत्र द्वारा प्राथीर् ने मुकदमा अपराध संख्या 158 सन 2023 अन्तगर्त धारा 120B, 409, 504, 506 भा०द०िव० थाना कैसरबाग िजला लखनऊ में अिग्रम जमानत की प्राथर्ना की है।

िदनांक 29.11.2023 को प्राथीर् सिहत चार लोगों के िवरुद्ध िलखाई गई प्रथम सूचना िरपोटर् में यह कहा गया है िक िशकायतकतार् ने जुनैद अहमद खान, हुनैद अहमद खान (प्राथीर्), प्रोपराइटर मेससर् ग्लोिरयस िहन्दुस्तान इन्फ्रा डेवलपसर् प्रा०िल० व सह-अिभयुक्त तािरक के माध्यम से 15 लाख रुपये व्यवसाय में लगाये थे िजसमें उसे हर 3 माह पर एक लाख पचास हजार रुपये लाभ िमलना तय हुआ था तथा इस संबंध में एक िलिखत अनुबंध भी तैयार िकया गया था िकन्तु िशकायतकतार् को कोई रुपया नहीं िदया गया।

प्राथर्ना-पत्र के साथ प्रस्तुत शपथ-पत्र में कहा गया िक प्राथीर् िनदोर्ष है।

प्रथम सूचना िरपोटर् में किथत अनुबन्ध में प्राथीर् पक्षकार नहीं है तथा यह अनुबंध मेससर् ग्लोिरयस िहन्दुस्तान इन्फ्रा डेवलपसर् प्रा०िल० द्वारा िनदेशक जुनैद अहमद खान एवं िशकायतकतार् मुकेश केसरवानी के मध्य िनष्पािदत हुआ था। प्राथीर् मात्र इस अनुबन्ध के िनष्पादन का साक्षी था।

एक पूरक शपथ-पत्र के माध्यम से चार अन्य आपरािधक प्रकरणों में प्राथीर् की संिलप्तता दशार्यी गयी है िजन भी में उसे धारा 41A दं०प्र०सं० के अंतगर्त नोिटस दी गयी है तथा िववेचना अभी लंिबत है।

उपरोक्त तथ्यों को दृिष्टगत रखते हुए, जबिक प्रथम सूचना िरपोटर् में मात्र एक व्यावसियक संस्था में एक अनुबन्ध के तहत िकये गये िनवेश पर धन वापसी न करने का कथन िकया गया है िजस अनुबन्ध में प्राथीर् पक्षकार नहीं है, न्यायालय का मत है िक प्राथीर् अिग्रम जमानत पाने का अिधकारी है।

तद्नुसार अिग्रम जमानत प्राथर्ना-पत्र स्वीकार िकया जाता है।

उपरोक्त मुकदमा अपराध संख्या में आवेदक की िगरफ्तारी/न्यायालय के समक्ष उपिस्थित की दशा में, उसे संबंिधत थाने के भारसाधक अिधकारी/न्यायालय की संतुिष्ट के अनुसार व्यिक्तगत बंध पत्र एवं दो प्रितभू प्रस्तुत करने पर परीक्षण के अंितम रूप से िनस्तारण तक, िनम्न शतोर्ं के अधीन अिग्रम जमानत पर िरहा िकया जाएगाः-

क- आवेदक, यिद आवश्यक होगा तो पुिलस अिधकारी द्वारा जॉच हेतु अपेिक्षत समय पर उपिस्थत होगा;

ख- आवेदक मामले के तथ्यों से पिरिचत िकसी व्यिक्त या पुिलस अिधकािरयों को प्रत्यक्ष या परोक्ष रूप से कोई धमकी, वादा या प्रलोभन नहीं देगा िजससे िक वह ऐसे तथ्य को न्यायालय के समक्ष या िकसी पुिलस अिधकारी के समक्ष प्रकट न करने पर मान जाए;

ग- आवेदक अदालत की पूवर् अनुमित के िबना भारत नहीं छोड़ेगा;

घ- आवेदक को प्रत्येक िनधार्िरत ितिथ पर ट्रायल कोटर् के समक्ष उपिस्थत होना होगा, जब तक िक व्यिक्तगत उपिस्थित से छूट न दी गयी हो;

ङ- आवेदक अिभयोजन पक्ष के गवाह पर दबाव नहीं डालेगा / धमकी नहीं देगा;

च- आवेदक िववेचना एवं िवचारण के दौरान सहयोग करेंगे और जमानत की स्वतंत्रता का दुरुपयोग नहीं करेगा।
