Learned counsel for the petitioner after arguing at some length submits that ends of justice can be met if an appropriate direction is issued by the court for expeditious disposal of the recall application filed by the petitioner dated 19.12.2024 seeking recall of ex parte order dated 16.76.2024, which has been assailed in the instant writ petition.
Learned Standing counsel for the respondent State submits that he has no objection in case such an order is passed.
Accordingly, without entering into the merits, this petition is disposed of with direction to the respondent no.3 to consider and decide the pending recall application of the petitioner after affording full opportunity of hearing to the parties concerned without granting any unnecessary adjournment.
It is made clear that this court has not examined the case of either parties on merits and the respondent no.3 shall decide the recall application on its own merits.
