Heard learned counsel for the appellant, learned AGA for the State of U.P. as well as perused the record.

The instant appeal has been preferred seeking following main relief(s):-

"Wherefore, it is most respectfully prayed that this Hon'ble Court may be pleased to allow the appeal and set aside the impugned Order Dated 18.09.2025 Passed By The Court Of Learned Special Judge, SC/St Act, Lucknow, In Criminal Misc. Case No. 3980/2025, 'Keshav Ram Vs Ram Krishna Singh' Under Section 173(4) B.N.S.S. [Old Section 156(3) Cr.P.C.] Pertaining to Police Station Chinhat, District - Lucknow, and kindly be pleased to direct the Police Station concerned to register the First Information Report on the application Under Section 173(4) B.N.S.S. [Old Section 156(3) Cr.P.C.] filed by appellant dated 22.05.2025."

Vide impugned order dated 18.09.2025 passed in Criminal Misc. Case No. 3980 of 2025 (Keshavram vs. Ram Krishna Singh), the Special Judge, SC/ST Act, Lucknow (in short "trial court") rejected the application preferred by the appellant in terms of Section 173(4) B.N.S.S., akin to Section 156(3) Cr.P.C. (now repealed).

The application(s) dated 12.04.2025, 21.04.2025 and 16.05.2025 (Annexure No. 1), alleged to have been submitted by the appellant before the Police Officer(s), are relevant in the instant case and being so the relevant portion of one of the applications i.e. application dated 12.04.2025 is extracted hereunder:-

"्ऺाथर् केशवराम पु्ऴ ्शी राम चरन, िनवासी: नौबस्ता कलां, हरदासी खेड़ा, थाना : िचनहट लखनऊ का िनवासी है। आरोपी रामकृष्ण िसह आयु लगभग, पु्ऴ ्शी नारायण िसह, िनवासी प्लाट नं. 1166, अमराई गांव, थाना इंिदरानगर, िजला- लखनऊ (मो. 9118004116) का (कबाड) का िबजनस करता हे ै। रहने वाला है। ्ऺ ाथर अन् सु िचत जाित का हू तथा वह सै ् ै प - आरोपी रामकृष्ण िसह से ्ऺ ाथर की प् ुरानी जान पहचान व सम्बंध ह। फरवरी 2024 में िवप्षी ने ्ऺाथर् से लोहे का कबाड़ खरीद कर रुपये एक लाख का भुगतान िकया था। िदनाकं 14 फरवरी 2024 , को रामकृष्ण िसह ्ऺाथर क् घर आया और साथ मे िमलकर कबाडें ़ का बड़ा िबजनस करने का े ्ऺ स्ताव रखा और ्ऺ ाथर को िबजन् स के े फायदे समझाये। रामकृष्ण िसह की बातो मं आकर ें ्ऺ ाथर साथ म् िमलकर कबाडें ़ का िबजनस करने को ते ैयार हो गया। रामकृष्ण िसह के कहने पर ्ऺाथर् ने अपनी लोडर गाड़ी व दस लेबर को लोहा काटने के िलए सम्भावली

शुगरिमल, बहराइच भेजा। टेंडर में खचर् करने के िलए रामकृष्ण िसह ्षारा पहले रुपये 2,23000/- मांगने पर ्ऺाथर् ्षार वालसर वाले गुप्ता जी से लेकर रामकृष्ण िसह को िदया। पुनः मांगने पर रुपये पचास हजार पुनः िवप्षी को ्ऺाथर् ्षारा िदया गया िजसके पूवर् रामकृष्ण िसह के कहने पर ्ऺाथर् ्षारा रुपये चार लाख ्शी अहमद अंसारी के बैंक खाते से पीसीपीएल कम्पनी जो िक रामकृष्ण िसह की है, में भेजा गया। इसके पूवर् िदनांक 16 फरवरी 2024 दो लाख रूपये कैश मंसूर अहमद से लेकर ्ऺाथर् ने रामकृष्ण िसह को मंसूर के सामने ही िदया। इस ्ऺकार 20 फरवरी 2024 को महेश के सामने पचास हजार रुपये कैश महेश से लेकर ्ऺाथर् ने िवप्षी को िदया। तथा कायर् के दौरान गैस िसलेंडर रुपये दस हजार का, गैस कटर रुपये बीस हजार का खरीद कर ्ऺाथर् ने रामकृष्ण िसह के पास भेजा। लोहे की कटाई होने के बाद ्ऺ ाथर् ने माल उठाने के िलए लोडर गाड़ी ्िैक भेजा, अहमद अंसारी ्िैक लेकर गए व ्िैक पूरा एक िदन खड़ा रहा परन्तु माल उठवाने के िलए रामकृष्ण िसह रुपये दस लाख मांगने लगा कहने लगा िक पहले हमारा िहस्सा दो। जबिक ्ऺ ाथर् ्ष ारा पूवर् म उसका िहसें ्सा िदया जा चुका था और फाइनल िहसाब होना था परन्तु रामकृष्ण िसह न न माल उठाने िदया और न ही े ्ऺ ाथर् 14,43,300 का रुपये ही वापस िकया। मागनं पर बाद मे दें ने की बात कर रहा हे । और उसनै े 45 ्ऺाथर को फोन भी ब् ्लाक कर िदया ह। उै ्व लोहा कटाई में िदन तक ्ऺ ाथर का लोडर गाड् ़ी व 10 लबरे , 2 गैस कटरमन नै काम िकया। रामके ृष्ण िसह न धोखाधडे ़ी करके ्ऺ ाथर क् रे पयोू ं व ससाधनों का उपयोग िकया हं और अपनै वायदे से मे कर गया हु ै। िजसक कारण े ्ऺ ाथर को ् 14,43,300/रपयू े की ्ष ित व मानिसक व शारीिरक पीड़ा हुई है। उपरो्व सम्बंध म जब ें ्ऺाथर हरदासी ख् ेड़ा िनवासी मन्जू गौतम के साथ बात करन िदनाे क ं 10.04.2025 को सबह ु लगभग 8.30 बजे रामकृष्ण िसह के घर गया तो वहा कई लोग बं ैठ थें े। रामकृष्ण िसह ने ्ऺ ाथर् स कहा िक ते ुम्हार वजह से हमे नें कसान हो गया हु और कहनै लगा िक उसने माल दे ूसरे को उठवा िदया है ्ऺ ाथर् ्ष ारा अपना रुपया मागनं पर रामके ृष्ण िसह ्ष ारा जाितसचक गािलयाू दं ेने लगा और कहन लगा िक चमरऊ साले उठ के ुसर स् ते ुम्हारी औकात नही हं कै सरु पर ब् ैठन की े और यह कहकर जोर स लात मारकर के ुसर स् नीचे े ढकेल िदया तथा िवप्ष ी न मे ह मुं भरा ें गुटखा ्ऺ ाथर क् े ऊपर थूक कर ्ऺ ाथर को लात स् मारकर भागने के े िलए कहा िक दुबारा यहां िदखाई न देना नही तो तं ुम्हारी औकात तुम्हें बता दगे ें।

अतः िनवेदन है िक ्ऺथम सूचना िरपोटर् आरोपी रामकृष्ण िसह के िवरु्ध दजर् कर आवश्यक कायर्वाही करने की कृपा करें। धन्यवाद।"

A perusal of above quoted portion of the application dated 12.04.2025 indicates that the appellant and opposite party No. 2 started a scrap business 'स ् ैप (कबाड़)' and in the said business, the appellant invested some amount and the opposite party No. 2 has not returned/paid the amount due i.e. Rs. 14,43,300/- to the appellant.

Upon due consideration of the aforesaid, this Court finds that the appellant just to get/recover Rs. 14,43,300/- from the opposite party No. 2 initiated the proceedings in issue and therefore, this Court is not inclined to cause any interference in the impugned order dated 18.09.2025 passed by the trial court.

For the aforesaid reason, the instant appeal is dismissed .
