Respondent no. 2 has filed compliance affidavit (which is taken on record) enclosing therein the copy of the committee report and consequential order passed rejecting claim of the applicant for minimum of the regular pay scale on the ground that the applicant is not performing the similar duties which are discharged by those engaged on regular basis.

Learned counsel for the applicant after arguing at some length has submitted that the applicant may be permitted to withdraw the present contempt application as dismissed as not pressed with liberty to file a writ petition challenging the orders rejecting claim of the applicant.

In view of above, the present contempt application is dismissed as not pressed.

However, it is open for the applicant to avail the remedy as may be permissible under law.
