Heard learned counsel for applicant and Mr. Alok Kumar Misra learned counsel for opposite party.
Application under Section 24 CPC has been field seeking transfer of regular suit No. 183 of 2024 instituted by opposite party under Section 13 of Hindu Marriage Act from Family Court Gonda to District Faizabad/Ayodhya.
Although learned counsel for opposite party submits that applicant in fact is residing at Lucknow but it appears from record that there are other cases between the parties which are pending consideration in Faziabad/Ayodhya.
Learned counsel for opposite party on the basis of instructions submits that he does not have any objection to the case being so transferred.
In view thereof, the regular suit No. 183 of 2024, Tarun Kumar Pathak versus Awantika Mishra pending before Family Court Gonda shall stand transferred to District Faizabad/Ayodhya. The court concerned is directed to conclude the aforesaid proceedings expeditiously without granting undue adjournments to either parties.
The application therefore stands allowed.
