Offences under Sections 363, 366 IPC and Section 3(1)(xi) SC/ST Act (Case Crime No. 71 of 2015; Criminal Case No. 4010 of 2015). On the parties arriving at a compromise — referred by this Court vide order dated 26.07.2024 to the court below for verification, and verified by the learned trial court/Special Judge vide order dated 12.08.2024 (verification order annexed to supplementary affidavit dated 18/19.09.2024) — and taking into account various Apex Court judgments, the appeal was disposed of in terms of the compromise and the trial-court proceedings were quashed. The victim, examined as P.W.-2, had deposed that she wilfully accompanied appellant no.1 to Delhi and lived with him 7-8 months as his wife, and after her statement under Section 164 Cr.P.C. returned to live with her father; she has not deposed against the appellant, has since married him, and they have two children aged about 8 and 5 years.

Heard learned counsel for the appellant, learned A.G.A. and learned counsel for respondent no.2.

Learned counsel for the appellant submits that the parties have arrived at compromise and this Court vide order dated 26.07.2024 has referred the compromise to learned court below for verification.

The matter relates to the offence under Sections 366,363 IPC and #(1) (XI) of SC/ST Act .

The victim had stated in her statement before the Court as P.W.-2 that she willfully went with the appellant- Pradeep Kumsr to Delhi and she lived with him for 7-8 months as his wife. She came back with him in September and after recording of her statement under Section 164 Cr.P.C. before the Magistrate she has been living with her father. Thus, the victim has not deposed against the appellant.

He next submitted that the learned trial court has verified the compromise and the verification order has been filed as Annexure to the supplementary affidavit dated 18/19.09.2024. The victim has married with appellant no.1 and they are blessed with two children abed about 8years and 5 years The victim and appellant no.1 are living healthy and peaceful life and even the complainant has no grievance with the appellant no.1.

Taking into the various judgment passed by the Apex Court Supreme Court in this regard, the appeal is disposed of in terms of the compromise entered between the parties verified by learned Special Judge vide order dated 12.08.2024.

The proceedings before the trial court in criminal Case 4010 of 2015 arising out of Case Crime No. 71 of 2015 under Sections 363,366 IPC and Section 3(1) (XI) SC/ST Act are hereby quashed in terms of the compromise .

The appeal is disposed of accordingly.
