Heard Sri Mohammad Aziz Mansuri, learned counsel for the applicant, Sri Mayank Sinha, learned Additional Government Advocate for the State and perused the records.

This is the second application filed seeking release of the applicant on bail in Case Crime No. 297 of 2022, under Sections 147, 148, 149, 323, 504, 307, 452 I.P.C., registered at Police Station Ishanagar, District Kheri. The first bail application bearing No.1066 of 2023 was rejected by means of an order dated 04.08.2023.

Pressing the second application for bail the learned counsel for the applicant has submitted that six prosecution witnesses have already been examined and thereafter two defense witnesses were also examined and when the case was fixed for hearing submissions the prosecution has filed an application seeking production of an additional witness which application has been allowed and the matter has been fixed for 15.10.2025 for examination of additional witness.

In these circumstances, when the trial is almost at the conclusion stage and six prosecution witnesses have already deposed against the applicant, there is no good ground to enlarge the applicant on bail.

Accordingly, the second bail application is rejected . However, as the applicant is languishing in jail since 09.06.2022 it is provided that the trial court shall proceed with the trial expeditiously and shall conclude the same at the earliest without granting any unnecessary adjournments to any of the parties and by fixing consecutive dates at short intervals.
