Heard learned counsel for petitioner and learned State counsel for opposite parties.

The present petition has been filed seeking a direction to opposite parties to consider petitioner under the Old Pension Scheme.

It is submitted that father of petitioner late Nagendra Pratap Singh passed away in harness on 11.04.1997 thereafter petitioner applied for compassionate appointment on 08.09.1997 whereafter various correspondence ensued between authorities and ultimately petitioner was appointed on 10.01.2008 which is after the cut off date of 01.04.2005.

It is submitted that since appointment of petitioner was delayed only on account of opposite parties despite the fact that he had submitted his application within time in the year 1997, his grievance is required to be redressed that his appointment should relate back to the date of his initial application and not on account of the belated appointment letter.

Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to file a fresh representation before opposite party No.1 i.e.
