Bail Application No. 11412 of 2025 of Rambabu Dubey, who was in jail since 11.9.2025 in FIR No. 430 of 2025 (sections 69 BNS, P.S. Kotwali Dehat, District Gonda), wherein, per learned counsel's narration of the FIR, it was alleged that the applicant had formed a physical relationship with a victim aged around 23 years for the last 8 years under false pretext of marriage. Considering the victim's age and the long span of the relationship, and expressly without commenting upon the merits of the case, and noting that the applicant had no criminal history, the Court held him entitled to be enlarged on bail and directed his release on a personal bond with two sureties of Rs.20,000/- each, subject to conditions requiring attendance at hearings, abstention from similar offences, and no inducement, threat or promise to witnesses or tampering with evidence.

1. Heard learned counsel for the applicant, learned AGA and perused the record.

2. The applicant seeks enlargement on bail in FIR No. 430 of 2025, under sections 69 BNS, P.S. Kotwali Dehat, District Gonda.

3. Learned counsel for the applicant argues that in terms of FIR it was alleged that the applicant was forming physical relation with the victim for last 8 years under false pretext of marriage. The age of victim is around 23 years.

4. Learned AGA has opposed the bail application.

5. Considering the age and the fact that the relationship continued for long span of time, however, without commenting upon the merits of the case, the applicant who is in jail since 11.9.2025 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed.

6. Let the applicant Rambabu Dubey be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and
