This court has passed the following order on 04.11.2025:

“It appears that the Court had passed order on 11.7.2024 under the Domestic Violence Act and the applicant moved application for recall of the said order on the ground that it was an ex parte order. The application was allowed vide order dated 27.9.2024 on the cost of Rs.20,000/-. The applicant did not deposit the amount of Rs.20,000/-, therefore, recovery warrant has been issued.

It has been submitted by the learned counsel for the applicant that the order was recalled but the applicant could not deposit the amount of Rs.20,000/- and he is ready to deposit the amount. Applicant will bring the bank draft of Rs.20,000/- in favour of opposite party no.2 within one week.

List this case on 17.11.2025 in top ten cases. Interim order if any granted earlier shall continue to operate till the next date of listing.”

In compliance of the aforesaid order, bank-draft of Rs. 20,000/- (Twenty thousand only) in the name of opposite party No. 2 towards the costs imposed has been brought by learned counsel for the applicant.

Same is handed over to the learned counsel for the opposite party No. 2, who will handover the said bank-draft to Priya Waliya, opposite party No. 2.

Learned counsel for the opposite party No. 2 has no objection to the application being disposed of, since the costs amount has already been paid to him through bank draft.

In view of the aforesaid factual aspect, recovery-warrant is stayed , however, further proceedings of the case will go on before the court below and the applicants will not take adjournment. The Court below will decide the case within 3 months from the date of production of certified copy of this order.

With these observations/directions this application is disposed of .
