Heard learned counsel for the applicants and learned A.G.A. for the State.

Vakalatnama filed by Sri Shubham Dixit, Advocate on behalf of opposite party No.2 is taken on record.

The present 482 Cr.P.C. application has been filed to quash the entire proceeding of Criminal Case No. 104733 of 2023 arising out of case crime no. 0634 of 2022, under Sections 147, 148, 323, 504, 506, 427 IPC, Police Station- Chinhat, District Lucknow pending in the court of Additional Chief Judicial Magistrate VTH, Room No. 27, Lucknow along with charge-sheet No. 01/2022 dated 15.08.2022 and summoning order date 06.09.2023 passed by the court of Additional Chief Judicial Magistrate VTH, Room No. 27, Lucknow on the basis of compromise dated 16.09.2025.

Learned counsel for the applicant submits that now parties have entered into compromise, therefore, this Court may please to quash the proceeding for which Sri Shubham Dixit, learned counsel for the opposite party no.2 has no objection.

Whether the parties have, in fact, compromised the matter or not, can best be ascertained by the Court below as such compromise has to be duly

verified in presence of the parties concerned before the Court.

Accordingly, this application is disposed of with a direction to the court concerned that if any such compromise is filed before it within two weeks, it shall issue notices to all the signatories to the compromise requiring their personal presence and, thereafter, proceed to verify the compromise within two weeks. If the aforesaid compromise is verified, a report to that effect shall be prepared by the court and the compromise will be made part of the record.

The court in that scenario will allow the parties to obtain certified copy of the report as well as compromise and it will be open to the applicants to approach this Court again for quashing of the proceedings.

For a period of one month, the proceedings of Criminal Case No. 104733 of 2023 arising out of Case Crime No. 0634 of 2022, under Sections 147, 148, 323, 504, 506, 427 IPC, P.S. Chinhat, District Lucknow pending in the Court of Additional Chief Judicial Magistrate VTH, Room No. 27, Lucknow, shall remain stayed.

Office is directed to return the original compromise deed to the learned counsel for the applicants, if any, after taking the photocopy of the same.
