Sri Adarsh Shukla, learned counsel, holding the brief, appears for the applicants and submits that the F.I.R. has been lodged by opposite party no.2 against the accused-applicants on 19.01.2024, which was registered as Case Crime No. 6 of 2024under Sections 323, 504 and 506 I.P.C. at Police Station Naveen Modern, District Shravasti for the occurrence of 18.01.2024 at 5.00 p.m. pertaining to the altercation between the two. The charge-sheet is submitted for the offfence which is compoundable. Accused-applicants have previously approached this Court in Application under Section 482 Cr.P.C. No. 9221 of 2025, which was disposed of by order dated 03.11.2025 with the observation that there is compromise which has been sent for verification before the trial court. The relevant paragraph is reiterated underneath:

"4. Learned counsel for the applicant submit that both the parties have amicably compromised their dispute. The compromise which has taken place between the parties is also filed before this Court as Annexure No.3 to the application.

5. Whether the parties have, in fact, compromised the matter or not, can best be ascertained by the Court below as such compromise has to be duly verified in presence of the parties concerned before the Court" .

In pursuance of order passed by this Court, the court concerned (Judicial Magistrate, Shravasti) by order dated 13.11.205 has verified the compromise, which is at page no. 66 of the application, hence he seeks

intervention of this Court to quash the charge-sheet and entire proceedings of the case.

Learned A.G.A. is present for State-opposite party no.1 and submits that there is compromise in the compoundable offences.

Sri Akhil Anand, learned counsel appears for opposite party no.2 and hands up Vakalatnama . The same is taken on record. He admits the factum of compromise between the parties which is verified..

Thus, the charge-sheet and the proceeding of Case No.1459 of 2024 (Sandeep Kumar and another Versus State of U.P. and another), arising out of Case Crime No.0006 of 2024, under Sections 323, 504, 506 I.P.C., Police Station Naveen Modern Police Thana, District Shrawasti is quashed in terms of compromise between the parties.

The application is allowed, accordingly.
