1. Heard learned counsel for the petitioner and Sri S.B. Pandey, Deputy Solicitor General of India and learned Senior Advocate assisted by Sri Varun Pandey, learned counsel for the respondent.
2. This petition has been filed with the following main prayer:-
"i. Issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent no.2 and 3 to issue a new passport with correction in the Date of Birth and the residential address of the Petitioner, expeditiously."
3. It is the case of the petitioner that he was issued a passport initially in the year 2010 and the same was expired on 27.09.2020. The petitioner applied for renewal of his passport for the first time on 06.08.2023, and thereafter again on 07.03.2024. He has presented all requisite documents before the Regional Passport Officer, but his passport has not been issued on the ground that the original passport indicated his date of birth as 24.12.1988, and his address as House No.71-C, Shringarnagar, Post Office Alambagh Lucknow, whereas his date of birth as mentioned in his matriculation certificate is 24.07.1990, and his residence as per his Aadhar Card i.e. House No.7-C, Shringarnagar, Alambagh, Lucknow.
4. Learned Counsel for the petitioner has placed reliance upon a judgement rendered by the Delhi High Court in Writ Petition (C) No.10839 of 2015: Sunita Sawhney Vs. Union of India and others .
5. Learned counsel for the respondent has placed reliance upon affidavit filed by the petitioner at the
time of his initial application for issuance of passport in the year 2010, and also the guidelines issued by the Ministry of External Affairs.
6. Let a counter affidavit be filed by the respondents within a period of four weeks.
7. One week's time thereafter shall be available to learned counsel for the petitioner to file rejoinder affidavit.
