(1) Heard the learned counsel for the petitioners and the learned Standing counsel who appears for the Staterespondents nos.1, 2 & 3 and Shri Aftab Ahmad, who appears on behalf of the Opposite party nos.4 & 5.

(2) This petition has been filed by the petitioners for the following main prayer:-

"1) To issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to pay the compensation for illegal Demolition of boundary wall of the petitioners, in the interest of justice."

(3) It is the case of the petitioners that the husband of the Petitioner no.1 Late Ram Kumar Verma, had purchased 2500 Sq.ft. land through a registered Sale Deed from the recorded tenure holder of part of Gata No.15, situated at Village Badel, Ward- Begumganj, Mohalla Civil Lines, Nagar Palika Nawabganj, Tehsil- Nawabganj, District Barabanki. After such purchase, the husband of the Petitioner no.1 has raised boundary wall of 6 ft. around his land to protect it from encroachment. After the death of husband of the Petitioner no.1, the land was transferred in the name of the Petitioner no.1 and her son in 2013. All of a sudden on 28.06.2024, the Opposite party no.3, S.D.M. /Prescribed Authority Regulated Area, Barabanki, started demolishing boundary wall. There is no compensation for demolishing of such boundary wall, hence, this petition has been filed.

(4) List this matter in the next week, as fresh.

(5) In the meantime, the Respondents shall seek written instructions with regard to the allegations made in the petition.
