- Heard Sri Dharmendra Singh, learned counsel for petitioner as well as learned Standing Counsel for respondent Nos. 1 to 4 and Sri Mohammad Aslam Beg, learned counsel for respondent No. 7.
- By means of present writ petition, the petitioner has challenged the order dated 22.04.2024 passed by Additional Commissioner (Administration), Lucknow Division, Lucknow in Case No. 1419/2023 (Mahesh Prasad & others Vs. Amber Lal & others) wherein by means of impugned order the patta granted to the petitioners on 02.01.2007 has been cancelled.
- It has been submitted by learned counsel for petitioner that on the previous occasion also an application for cancellation of patta as moved by another complainant which has already been rejected on 02.07.2014. He submits that the present complaint was made on 31.12.2014 beyond the period of limitation provided in Section 198(4) of the U.P. Z.A. & L. R. Act and consequently no cognizance of he same could have been taken by the prescribed authority on the face of it beyond jurisdiction.
- Learned counsel for respondents prays for and are granted three weeks tile to file counter affidavit. Petitioner shall have two weeks thereafter to file rejoinder affidavit.
