Heard learned counsel for the petitioner, Sri Vineet Pandey, learned counsel for respondent nos.4 and 5 and learned Standing Counsel for the State.

The writ petition has been filed with the following prayer:

"i. TO ISSUE, a writ, order or direction in the nature of mandamus directing the respondent no.2 to consider and decided the Stay Application as well as Revision No. NIL of 2024 Laxman @ Lakhan Bahadur Mudgal Vs. The Chairman Agra Development Authority and others filed by the petitioners under Section 41 of the U.P. Urban Planning and Development Act 1973 as expeditiously as possible preferably within the time stipulated by this Hon'ble Court and till the decision of the Stay Application the coercive measures and demolition proceedings in pursuance of the orders dated 23.09.2024 and 23.06.2017 passed by respondent no.3 and 5 may be stayed to meet the ends of justice;"

It is submitted by learned counsel for the petitioner that Stay Application as well as Revision No. NIL of 2024 (Laxman @ Lakhan Bahadur Mudgal Vs. The Chairman Agra Development Authority and others) filed by the petitioner under Section 41 of the U.P. Urban Planning and Development Act, 1973, is pending consideration before the respondent no.2. The direction may be issued for expeditious disposal of the same.

Learned Standing Counsel submits that the revision of petitioner would be decided in a time bound manner.

Considering the facts and circumstances of the case, it is hereby directed that the Revision No. NIL of 2024 (Laxman @ Lakhan Bahadur Mudgal Vs. The Chairman Agra Development Authority and others) filed by the petitioner under Section 41 of the U.P. Urban Planning and Development Act, 1973 pending before

respondent No.2-The Secretary, Department of Urban Planning and Development, Government of Uttar Pradesh, Lucknow, be decided expeditiously preferably within a period of one month from the date of production of a certified copy of this order.

If the petitioner is subjected to demolition proceeding, he would be at liberty to press the stay application before the revisional authority and the revisional authority would oblige under law to pass an order within seven days.

With the aforesaid observation/direction, the writ petition stands disposed of.
