Having heard learned counsel for the petitioner, Shri Akash Ojha, holding brief of Shri Rishu Mishra, learned counsel for the private-respondents and learned Standing Counsel for the Staterespondents, at present, petitioner is claiming payment of Rs. 5,82,972/- against the work claimed to have been executed by it against tender no. 31/EDC(D)/2015-16.

Facts are not ascertained. In any case the decision to make payment has to be made by the respondent no. 6. No such decision has been made by that authority till date.

In view of the above, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit, at this stage. Accordingly, the writ petition is disposed of with the direction, subject to the petitioner filing a fresh representation before the respondent no. 6 supported by personal affidavit of the petitioner annexing thereto all relevant documents on which the petitioner may seek to rely and/or upload the bills on the web portal designed for that purpose, that representation may be dealt with and decided strictly in accordance with law within a period of two months from the date of compliance of shown by the petitioner.

Any amount found due and payable may be paid out within a further period of two months.
