Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Vinay Shanker, learned counsel appearing for opposite party no.3/ Indian Bank (Erstwhile Allahabad Bank).
This petition has been filed with the following main prayer:-
"(a) Issue a writ order or direction in the nature of certiorari for quashing of the totally forged and manufactured recovery proceedings so initiated against the late mother of the petitioner in respect of alleged loan so secured by her to the tune of Rs. 5 lacs bearing loan account no. 50315868026 and Rs. 2.60 thousand bearing account No.50315867974 from the respondent bank on 01.07.2016 notwithstanding the fact that she had already left for her heavenly abode on 03.01.2016, in the interest of justice."
It is the case of the petitioner that his mother died on 03.01.2016 but loan has been sanctioned of Rs.260000/by the bank to her on 01.07.2016 on the basis of fraudulent papers submitted by someone other than the petitioner.
