Heard learned counsel for the petitioners, learned Standing Counsel appearing on behalf of the State Respondents and Sri Ratnesh Chandra, learned counsel appearing on behalf of the respondent nos.3 and 4.
This petition has been filed with a prayer or direction to be issued to the Lucknow Development Authority and the District Administration to remove the board of various Advocates which has been put up on the property of the petitioners and to also stop the illegal constructions being made by such Advocates.
Sri Ratnesh Chandra, learned counsel for the respondent, has pointed out from the pleadings on record the paragraph-4, which says that petitioner no.1 has some dispute with his paternal uncle Prakash Chandra Agarwal with regard to the property/ House No.242/90 situated in Mohalla Narendra Das Lane Yahiaganj, Chowk, Lucknow and Prakash Chandra Agarwal has engaged some Advocates who are acting on his behalf and they have removed the belonging of the petitioners over the property in question and demolished the original existing house and are raising new construction over it.
Learned counsel representing the Lucknow Development Authority has pointed out that the petitioners have not impleaded Prakash Chandra Agarwal, his paternal uncle and has also not impleaded Advocates whose names can be clearly read from the board that has been put up on the property in question, namely, Mohd. Ameen Beg,
Mohd. Talha, Sri Y.A. Khan, Mohd. Asim Nagrami and Sri Prakhar Srivastava.
Learned counsel for the petitioners shall move an appropriate impleadment application.
