This writ petition has been filed with the following prayer:

"Issue a writ, order or direction in the nature of mandamus directing the respondent no. 1 to hear and decide the issue of maintainability of claim petition registered as M.A.C.P. no. 1317 of 2016 in a time bound manner preferably with in a month. "

The sole prayer made in the writ petition is for a direction upon the Tribunal to hear the issue in regard to maintainability of the claim petition and decide the same within fixed period of time.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Presiding Officer, Motor Accident Claims Tribunal (South) Kanpur to decide the issue of maintainability of claim petition registered as M.A.C.P. No.1317 of 2016, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order.

With the aforesaid direction, present writ petition stands disposed of.

It is made clear that this Court has not adjudicated the case on merit.
