Heard learned counsel for the petitioner, Sri S.B.Pandey, learned Senior Advocate cum Deputy Solicitor General assisted by Sri Anand Dwivedi, learned counsel appearing on behalf of the respondents no. 3 & 4 and Sri Pankaj Kumar Awasthi, learned counsel for the respondents no. 5.

There is consensus at bar that the matter in issue is squarely covered by an interim order of this Court dated 21.10.2022 passed in Writ-C No. 6168 of 2022 in re: Bramharshi Sriamkrishan (B.S.R.K) Private I.T.I Khalisa Muhammadabad, Mau vs. Union of India and ors , a copy of which has been filed as part of Annexure-9 (page 74) to the writ petition.

Accordingly taking into consideration the aforesaid consensus, it is provided that the petitioner would also be entitled for the benefit of an interim order passed by this Court in the case of Bramharshi Sriamkrishan (B.S.R.K) (supra).

All the respondents are granted four weeks time to file a counter affidavit within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
