Learned counsel for petitioner is granted liberty to correct the nomenclature of the school concerned in the name of present petitioner during the course of day.

This petition pertains to issuance of direction to the concerned authority for extending benefit of grant-in-aid to the institution for purposes of salary payment to teachers in the attached Primary Section of the Thakurdeen Amar Punj Laghu Madhyamik Vidyalaya, Gaura Samar Singhpur, Ambedkar Nagar.

Learned counsel for petitioner has placed reliance on judgment rendered by this Court in the case of State of U.P. and others versus Pawan Kumar Dwivedi , 2014 (9) SCC 692 .

Since consideration of petitioner's grievances would entail factual aspects, liberty is granted to petitioner to file a fresh representation before the opposite party no. 1 i.e. Principal Secretary, Department of Basic Education, Civil Secretariat, U.P. Lucknow who shall consider and decide the same within a period of three months from the date a certified copy of this order is produced before the said authority, in the light of judgment rendered by this Court indicated hereinabove, in case the same is applicable.
