Heard Sri S.P. Singh, learned counsel for the petitioners and Sri Ashish Dubey, learned standing counsel for the State-respondent nos. 1 & 2.

By means of the present writ petition the petitioners have challenged the order dated 20.05.2024 passed by the Deputy Registrar, Firms, Societies and Chits, Mohanpuri, Meerut.

From the perusal of the impugned order dated 20.05.2024, it is evident that the Deputy Registrar has referred the matter to the Prescribed Authority / Upziladhikari, Sadar, Meerut (respondent no. 7), under Section 25 of the Societies Registration Act, 1860 to take a decision in the matter.

Learned counsel appearing on behalf of the petitioners submits that the Prescribed Authority / respondent no. 7 is seized with the matter and the same was fixed on 22.07.2024. He further submits that the petitioners have already submitted their reply on 20.06.2024.

Learned Standing Counsel makes an statement that he has no objection only to the extent that a direction is issued by this Court for expeditious disposal of the case within stipulated period as to be fixed by this Court.

In view of the nature of the proposed order to be passed, the service of notice upon the respondent nos. 3, 4, 5 & 7 is dispensed with.

In view of the aforesaid situtation, this Court is of the considered opinion that no useful purpose would be served to keep this writ petition pending as the Prescribed Authority is seized with the matter and the petitioners have already filed their objections, the petitioners have ample opportunity to press all the objection

before the authority concerned.

Accordingly, without adverting on the merits of the case, the present writ petition is disposed of with a direction to the Prescribed Authority / respondent no. 7 to expeditiously decide the matter by a reasoned and speaking order, strictly in accordance with law, after affording full opportunity of hearing to the concerned parties.

It is expected that the Prescribed Authority / respondent no. 7 shall take final decision in the matter as early as possible preferably within a maximum period of three months from the date a certified copy of this order is produced before it.
