Heard Sri Ankur Agarwal Advocate holding brief of Sri Rahul Agarwal, learned counsel appearing for the petitioner and Sri S.P. Singh, learned A.S.G.I. assisted by Sri Vivek Kumar Singh, learned counsel appearing for the respondents.

By order dated 18.01.2024, the petitioner firm was delisted and further penal action for blacklisting was initiated against the petitioner. Subsequently by order dated 04.03.2024 the same officer has submitted that the matter for blacklisting of the firm is before the Railway Board and accordingly, the appeal against delisting cannot be considered.

Learned counsel appearing on behalf of the respondents submits that since the delisting order was itself passed by the C.A.O./C.O.R.E., there is no specific provision for hearing of this appeal as normally the appeals are heard by C.A.O./C.O.R.E.

Learned counsel appearing on behalf of the respondents submits that the appeal with regard to the delisting may be heard by the General Manager/C.O.R.E.

In light of the above submission made, the General Manager/C.O.R.E. is directed to grant an opportunity of hearing to the petitioner and thereafter pass a reasoned order with regard to the appeal filed by the petitioner within a period of three weeks from today.

With the above direction, this writ petition is disposed of .
