Shri Siv Sagar Singh, learned counsel for the petitioner, in support of his submissions, states that the quantum of work and admissible amount has been accepted by the authority, but despite this, the same has not been released in favour of the petitioner.

Shri M. N. Singh, learned counsel for the respondents, has raised an objection that in terms of the agreement entered into between the parties, the petitioner has an efficacious remedy to press the claim before the arbitrator. In support of his submission, he has placed reliance upon clause 37 of the agreement.

Considering the factual situation, as the entire claim is based on the agreement entered into between the parties, let Shri M. N. Singh, learned counsel for the Respondent, bring on record the agreement which was entered into between the parties. He may also obtain further instructions in the matter.
