Case called out. None appears on behalf of the petitioner to press this petition which was filed on 27th of May, 2010.

The writ petition has been filed challenging the validity of the order dated 30.08.2005 passed by 5th Additional District Judge, Faizabad in Misc. Civil Appeal No. 66 of 2004, whereby the appeal filed against an order dated 28.05.2004 passed in Regular Suit No. 100 of 2004, issuing an order of temporary injunction against the petitioner, was allowed and the matter was remanded for decision of the temporary injunction application afresh, after hearing the parties.

As the impugned order merely remands the matter for decision on an application for temporary injunction afresh, it appears that no injustice has been caused to the petitioner by means of the remand order, as it will open for the petitioner to take all the pleas available in law before the Civil Judge.

Accordingly, there appears no illegality in the impugned order dated 30.08.2005 passed by the 5th Additional District Judge, Faizabad. The writ petition lacks merit and the same is hereby dismissed. The interim order dated 28.05.2010 is hereby vacated.
