Heard learned counsel for the petitioners. Notice on behalf of the respondents No.1 to 3 has been accepted by the office of Chief Standing Counsel.
Under challenge is the order dated 25.03.2021 passed by the Deputy Director of Consolidation, Unnao, whereby the revision preferred by the petitioners was allowed. The petitioners have further challenged the order dated 13.02.2024 whereby their application for recall has been dismissed by the Deputy Director of Consolidation, Unnao.
Upon a pinpointed query been put to the learned counsel for the petitioners to indicate the laches in filing the petition while assailing the order of the year 2021 in the year 2024 coupled with the fact that once the revision of the petitioners was allowed by the Deputy Director of Consolidation, Unnao, then under what circumstances, the instant petition can be filed by them.
After arguing at some length, learned counsel for the petitioners could not indicate either of the too except referring to Paragraphs-22 to 25 of this petition to show that the petitioners were poor villagers and did not have necessary funds to file the petition. Even though if the said explanation can be taken in consideration but the fact remains that the revision of the petitioners was allowed and how they are aggrieved party to assail such an order also could not be substantiated.
In view of the aforesaid, this Court is not inclined to entertain the petition which is accordingly dismissed at the admission stage .
