Heard learned counsel for the parties.

Instant writ petition has been filed beseeching a direction commanding the consolidation authorities for demarcation and delivery of possession to the petitioner over his chak in pursuance of the provisions as enunciated under Section 28 of the U.P. Consolidation of Holdings Act (in brevity 'U.P.C.H. Act').

It is submitted that during the provisional consolidation scheme, the petitioner has purchased proposed chak no.569 from the original chak holder namely Jagmal s/o. Chandroop, however, till date, neither the aforesaid chak has been demarcated nor possession has been delivered over there, despite several directions issued by the authorities concerned. In this respect, the Settlement Officer of Consolidation has already constituted a committee for delivery of possession vide its order dated 12.06.2023. However, till date, no fruitful steps have been taken for delivery of possession.

Learned Standing Counsel has no objection, if a direction is issued to the authority concerned for expeditious disposal of fresh representation to be moved by the petitioner in this respect.

In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to dispose of the present writ petition finally, without making any observation on the merits of the case as mentioned in the present writ petition with a direction that petitioner is at liberty to move a fresh representation qua his grievance as averred in the instant writ petition before the Consolidation Officer (respondent no.2) within a period of three weeks from today who shall consider and decide the said representation for demarcation and delivery of possession in accordance with law, expeditiously, preferably within a period of four months from the receipt of certified copy of this order as well as self attested copy of the instant writ petition, if there is no other legal impediment.
