Heard Shri M. I. Farooqui, learned counsel for the petitioner and Shri Rishi Kant Rai, learned counsel, who has put in appearance on behalf of respondent No. 9. Learned Standing Counsel has accepted notice on behalf of the State-respondents. Shri Azad Rai, learned counsel has accepted notice on behalf of respondent No. 5.
The writ petition has been filed assailing the order dated 15.5.2024 passed in Second Appeal No. 3 of 2020 Kaushambi (Computer Case No. AL202000242003) (Abdulla versus Pankaj and others) as also the order dated 5.12.2023 and 18.10.2017 passed by the respondent No. 3 under Section 144 of the U.P. Revenue Code, 2006.
A preliminary objection has been raised by learned counsel appearing on behalf of respondent No. 9 that the petitioner does not have a locus to assail the orders impugned inasmuch as the petitioner was not a party to the proceedings before the Authorities below.
After some arguments, learned counsel for the petitioner Shri M. I. Farooqui prays for withdrawal of the writ petition with liberty to file appropriate petition in Public Interest in furtherance of the complaint filed by him against the respondent Nos. 6 to 11.
The writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
