Case called out. No one appeared on behalf of the petitioner to press the present petition.
It is stated by Ms. Ankita Mishra, Advocate, holding brief of Shri Rama Kant Dixit, who has filed his vakalatnama for opposite party No.3 that the sole petitioner namely, Ram Achal had expired in the month of November, 2017 as appears from the copy of the khatauni annexed as Annexure No.1 to the affidavit filed in support of application (C.M. Application No.IA/11 of 2023) for abatement of the writ petition.
She further stated that the opposite party No.4 had expired on 17.12.2015 as appears from copy of family register as also the copy of khatauni which is annexed as Annexure No.2 to the affidavit filed in support of application (C.M. Application No.IA/11 of 2023) for abatement of the writ petition.
She also stated that application for substitution has not been filed till date and taking note of these facts, present petition be dismissed.
Considering the aforesaid, this Court is of the view that keeping the present petition pending would be of no use.
Accordingly, the present writ petition is dismissed for want of prosecution.
