Heard Sri Ram Naresh Singh Chauhan, learned counsel for the petitioner and the Standing counsel for the respondents.

The innocuous prayer has been made in the present writ petition seeking a direction to the respondents to decide the representation. In the peculiar facts and circumstances of this case, this Court is not even inclined to pass such an order for deciding the representation looking to the fact that the matter relates to selection for the posts of constables in police department of U.P. held in 2009. The grievances were raised by certain individuals by filing writ petitions which were dismissed by this Court on 23.12.2014 against which Special Appeal (Defective) was preferred which were also dismissed on 18.5.2017 and subsequently Special Leave Petition preferred against the order dated 18.5.2017 was also dismissed on 6.10.2017. The petitioner had also filed writ petition against the said selection by filing Writ A No.15622 of 2018 which was dismissed on 27.7.2018 and subsequently Special Appeal was dismissed on 19.3.2021 and thereafter Special Leave Petition was also dismissed on 6.11.2023.

From the aforesaid, it is clear that the controversy has been settled and the challenge made to the said selections has been rejected even by the Supreme Court and subsequently the petitioner had approached this Court by filing Writ A No.5428 of 2024 which was dismissed as not pressed. It is noticed that even no liberty was granted to file a fresh petition yet again for the same cause of action the present writ petition has been filed.

In any view of the matter, once the matter has been given quietus by rejection of petitioner's SLP by Supreme Court, the matter cannot be re-agitated for passing any orders to the respondents to decide his representation. In light of the above, the present petition has been filed to reopen the issue as the challenge made by the petitioner to the selection in question has already attained finality by rejection of his SLP and even the previous writ petition was got dismissed as not pressed by the petitioner without obtaining permission to file afresh.

In the aforesaid circumstances, filing the present writ petition is nothing but an abuse of the process of law, as such, the same is d ismissed at the cost of Rs.500/- to be deposited by the petitioner in the library fund of Oudh Bar Association.
