Heard Mr. Ramesh Singh, learned counsel for petitioner, learned State Counsel appearing on behalf of opposite parties 1 and 2.

By means of the present writ petition the petitioner has sought a writ of mandamus to the respondents to consider the case of the petitioner for promotion from the post of Additional Deputy Commissioner of Police Grade Pay Rs.7600/- to Additional Deputy Commissioner of Police, Grade pay Rs.8700/- subject to the final order passed by U.P. Public Services Tribunal, Lucknow in claim petition No.1927/2023 ( Manisha Singh Vs. State of U.P. and others) .

It has been submitted that the petitioner was granted punishment of withholding 2 pay increments for the period of 3 years vide punishment order dated 19.9.2022. Against the said punishment order the petitioner filed claim petition bearing No.1927 of 2023 which is pending consideration before State Public Services Tribunal, Lucknow. It has been submitted that though the prayer sought in the present writ petition should have been made by the petitioner before the Tribunal in the aforesaid case but due to non availability of members the Tribunal is non functional and accordingly the petitioner has approached this Court for the aforesaid relief. Learned counsel for the petitioner submits that in similar circumstances this Court in Writ A No.5557 of 2023 had dispose of the writ petition with direction to consider the representation of the petitioner for promotion to the next post.

After arguing the matter at some length, it has been submitted on behalf of the petitioner that the grievance of the petitioner shall be substantially redressed in case respondent No.1 is directed to consider and decide the representation of the petitioner dated 14.10.2024, expeditiously.

Learned Standing counsel does not object to the aforesaid innocuous prayer made on behalf of the petitioner.

Accordingly, the petition is disposed of with a direction to respondent No.1 to consider and decide the representation of the petitioner dated 14.10.2024, as contained in Annexure No.7 to the writ petition, expeditiously, say within three weeks from the date a certified copy of this order is placed before him, in accordance with law and communicate the decision to the petitioner. the concerned authority.

With the aforesaid observations, the writ petition stands disposed of.
