Heard Shri Naveen Kumar Saxena, learned counsel for the petitioners, learned Standing counsel appearing on behalf of respondents No.1 & 3, Shri Ran Vijay Singh, learned counsel appearing on behalf of respondent No.2 and Shri Uday Veer Singh, learned counsel for the respondents No.4 and 5.

With the consent of learned counsels for the parties, the matter is being finally decided.

The grievance of the petitioners is that despite they having been given the additional charge of Head Master of the Institutions, they are not being paid salary for the said post.

It is contended that this aspect of the matter has already been considered by this Court in Writ A No.8948 of 2024 in Re: Manoj Kumar and 7 Others Vs. State of U.P. and 4 Others, decided on 01.07.2024, a copy of which is annexure 5 to the petition. It is prayed that the competent authority i.e. the respondent No.4 be directed to consider the claim of the petitioners for payment of salary as In-charge Head Master considering the judgment of this Court passed in the case of Manoj Kumar and 7 Others (supra).

Considering the aforesaid, let fresh individual representations be made by the petitioners to the respondent No.4 i.e. within two weeks from today for redressal of their grievance. In case the said individual representations are made, the respondent No.4 shall proceed to consider and decide the same in accordance with law considering the judgment of this Court passed in the case of Manoj Kumar and 7

Others (supra) , if applicable, and pass a reasoned and speaking order within a further period of six weeks from the date of receipt of the certified copy of this order.

With the aforesaid direction, the writ petition is disposed of .

It is made clear that this Court has not gone into the merits of the claim set forth by the petitioners.
