Learned counsel for the petitioner submitted that petitioner has filed SCC Cuit No. 2 of 2017 against the respondent Nos. 1 & 3, which was allowed vide order dated 25.05.2018 and direction was issued to pay electricity bill, but prayer for vacation of property in question was rejected with observation that defendant No.1-respondent No. 3 is present before the Court and agreed on the point that house in question shall be vacated within a year and possession shall also be given to the plaintiff-petitioner. Court has also made observation that both the parties shall proceed to execute the compromise to vacate the house in question not compelling the landlord to approach the Court again. He next submitted that this order has been passed on 25.05.2018, and thereafter, defendant No. 1-respondent No. 3 is continuously sending notices that they are trying their level best to rent out any of the house and vacate the house in question. He next submitted that more than six years have passed from the date of order, but till date position is the same and house has not been vacated.
