Heard learned counsel for the parties and perused the record.

The present writ petition has been preferred for issuing direction in the nature of MANDAMUS directing the Respondent No.2 i.e. Head Postmaster, Pradhan Dakghar, District Sultanpur to grant compassionate appointment to the Petitioner on Class IV post (sweeper) in the department under dying in harness rules.

Learned Counsel for Union of India has raised a preliminary objection regarding maintainability of the writ petition as the petitioner is having the alternative efficacious statutory remedy to file Original Application before the Central Administrative Tribunal.

At this stage, leaned counsel for the petitioner wants to withdraw the writ petition and dismissed as not pressed with liberty to approach the Central Administrative Tribunal.

Accordingly, the writ petition is dismissed as not pressed with the aforesaid liberty.
