Sri Dubey has stated that the disciplinary proceedings were initiated against the petitioner on 12.11.2021, thereafter, the departmental inquiry concluded; the Disciplinary Authority has issued the show cause notice and the petitioner submitted his explanation to the show cause notice on 20.03.2023, but no final decision has been taken by the Disciplinary Authority after 20.03.2023. Under the aforesaid compelling circumstances, the petitioner filed the aforesaid writ petition wherein specific direction has been issued by this Court to pass final order within a period of two months but after about ten months from the order being passed by this Court, the Disciplinary Authority has passed the final order punishing the petitioner vide order dated 23.07.2024 and no reason has been indicated in such punishment order as to why he has not complied with the direction being issued by this Court vide order dated 21.09.2023 (supra). In the meantime, the juniors to the petitioner have already been promoted on the next higher post i.e. the Senior Mining Officer but the candidature of the petitioner has not been considered for the aforesaid reason. The petitioner is to retire within a period of eight months and on account of the aforesaid punishment order, which is per se illegal and unwarranted based on no evidence, the petitioner may suffer irreparable loss and injury which cannot be compensated in terms of money.
