1. Heard Sri Ram Bali Tiwari, learned counsel for the petitioner and Sri Sandeep Sharma, learned Sanding Counsel for the State.
2. By means of this writ petition, the petitioner has prayed for the following reliefs:-
"(I) to issued a writ, order or direction in the nature of certiorari for quashing the impugned order dated 02.02.2016 passed by the opposite party No.1 which is Annexure No.1 to the writ petition.
(II) to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to count the past services rendered by the petitioner in work charge establishment as qualifying service for pension.
(III) to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to provide the pension to the petitioner along with appropriate interest forthwith.
3. Learned counsel for the petitioner has stated that the case in hand is relating to the payment of pension, therefore, this is a case of recurring cause of action.
4. Let the counter affidavit be filed within a period of four weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.
5. List this case in the week commencing 14.10.2024 within top ten cases.
