Heard learned counsel for petitioner and learned State Counsel appearing for opposite party no.1.

In view of order being passed, notices to opposite parties no.2 & 3 stand dispensed with.

Petition has been filed seeking a direction to concerned authority for payment of arrears of salary as well as current salary which has not been paid since the year 2019.

It has been submitted by learned counsel for petitioner that the petitioner is working on the post of Assistant in the Sadhan Sahakari Samiti Ltd.Badagaonkazi, Ambedkar Nagar but salary has not yet been paid despite petitioner continuing to provide services.

For the said grievance, petitioner has already submitted a representation but seeks liberty to file fresh representation before concerned authority. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.

Considering innocuous prayer being made by learned counsel for petitioner, without entering into the merits of the case and particularly since adjudication of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file a fresh representation before opposite party No.3 i.e. The Chairman, Sadhan Sahakari Samiti Ltd, Ambedkar Nagar or any other competent authority, which shall be considered and decided within a period of six weeks from the date a certified copy of this order is produced before the said authority. In case petitioner is found entitled for the said relief, actual payment thereof shall be ensured within a period of next six weeks thereafter.

With the aforesaid observation, petition stands disposed of .
