Heard Sri Ravi Shanker Tewari, learned counsel for the petitioner, Sri Sandeep Sharma, learned Additional Chief Standing Counsel and Sri Mohit Chandra, Advocate, holding brief of Sri Puneet Chandra, learned counsel for respondent No.3.
By means of the present petition, the petitioner has prayed the following reliefs:
(i) To issue a writ, order or direction in the nature of certiorari quashing the order dated 24.06.2024 (Annexure No.3) passed against the petitioner.
(ii) To issue a writ, order or direction in the nature of mandamus commanding the opposite parties to reinstate the petitioner on the post of staff nurse/nurse mentor at the CHC Iglas, Aligarh.
This is a case where earlier petition WRIT - A No. 3153 of 2024 (Km. Poonam Sharma) has been allowed vide order dated 23.04.2024 giving liberty to the respondents to proceed against the petitioner strictly in accordance with law but in compliance of the aforesaid order, the impugned order 24.06.2024 has been passed in utter violation of principles of natural justice and without considering the observations and directions issued by this Court in the aforesaid judgment. Learned counsel for the petitioner has stated that the impugned order dated 24.06.2024 is not sustainable in the eyes of law.
Sri Sandeep Sharma, learned Standing Counsel prays for and is granted ten days' time to seek written instruction in the matter.
