Heard learned counsel for petitioner and Mr. Syed Aftab Ahmad learned counsel for opposite parties.

Petition has been filed seeking a direction to the opposite parties for payment of post retiral benefits such as gratuity, earned leave encashment, security deposit etc. with admissible interest.

It has been submitted that despite petitioner having superannuated in the year 2019, aforesaid benefits have not yet been paid although there is no departmental inquiry pending against petitioner.

Learned counsel for opposite parties on the basis of instructions submits however that recovery proceedings under Section 68 of U.P. Cooperative Societies Act 1965 are under way.

In view of submissions advanced by learned counsel for parties, opposite party No.2 i.e.Managing Director, U.P. Cooperative Federation Limited, Lucknow is directed to take a final decision with regard to outstanding dues of petitioner within a period of six weeks from the date a certified copy of this order is submitted before the said authority. In case petitioner is found entitled for the aforesaid benefits, actual payment thereof shall be ensured within a period of six weeks thereafter. The concerned authority shall also take a decision in accordance with law with regard to interest on the delayed payment .

With the aforesaid directions, the writ petition stands disposed of.
