Heard Mr. H.G.S. Parihar, learned Senior Counsel assisted by Ms. Meenakshi Singh Parihar, learned counsel for petitioner, learned State Counsel appearing for opposite parties no.1 & 3, Mr. Ran Vijay Singh, learned counsel for opposite party no.2 and Mr. Abhinav Singh, learned counsel for opposite parties no.4 & 5.

Petition has been filed challenging order dated 15.09.2023 whereby petitioner's application for mutual transfer has been rejected on the ground that an inquiry against him is pending consideration.

Learned counsel for opposite party however submitted that the order impugned is merely a report submitted by the Basic Education Officer to the U.P. Basic Education Board and final decision has not yet been taken.

Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it appears that the order impugned dated 15.09.2023 is in fact only a report submitted by Basic Education Officer, Unnao with regard to petitioner's application for mutual transfer.

In view of aforesaid, opposite party No.2 i.e. Secretary, U.P. Basic Education Board, Allahabad is directed to take a final decision on the petitioner's application for mutual transfer within a period of two weeks from the date a certified copy of this order is served upon the concerned authority. It is made clear that no observation on merits of the case have been made by this Court.

With the aforesaid observation, petition stands disposed of .
