Heard Shri Brijesh Kumar Kuldeep, learned counsel for the petitioner and Shri Diwakar Singh, learned Standing Counsel for the State-respondents.

By means of this petition, the petitioner has prayed following main relief(s):-

"(i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to pay the family pension, gratuity etc to the petitioner since death of her husband Late Shri Amit Kumar on 02.06.2023.

(ii) Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no.5 to consider and decide the representation of the petitioner dated 25.05.2024 in accordance with law with in a time to be fixed by this Hon'ble court by passing a reasoned and speaking order, contained in annexure no.1 to this writ petition."

For redressal of aforesaid grievance of the petitioner, the petitioner has preferred representation dated 25.05.2024 but to no heed. He has further requested that petitioner may be given liberty to file a fresh representation and direction may be issued to opposite party no.5 to decide the said representation with expedition.

Learned Standing Counsel has no objection if a direction for disposal of fresh representation is issued.

Therefore, without entering into merits of the issue, this writ

petition is disposed of finally at the admission stage giving liberty to the petitioner to prefer a fresh representation before the opposite party no.5 i.e., Assistant Excise Commissioner, Lucknow, taking all pleas and grounds, which are available to her, enclosing therewith copies of earlier representation and other relevant documents, which are necessary for disposal of the representation, within a period of ten days from today and if such representation is preferred by the petitioner within aforesaid period, the authority concerned shall consider and decide the same strictly, by speaking and reasoned order, in accordance with law and with expedition, preferably within a period of eight weeks from the date of receipt of certified copy of this order and the decision thereof shall be intimated to the petitioner forthwith.
